is evidenced by, and includes but is not limited to, that fact that Royal failed to provide for, or participate in, the defense of Cambridge Townhomes, LLC against claims made by the Cambridge Townhomes Homeowner’s Association regarding Cambridge Townhomes, LLC’s liability arising out of Interwest Industries’ work on the Cambridge Townhomes project.
